Terms and Conditions

1. With the conferral of a contract, the client automatically accepts the general business conditions.

2. The realty contract does not require a form. The contract is made when the client uses the services of the firm B. Hilleprandt or makes no objection to them. It is enough when the firm B. Hilleprandt becomes involved at the conclusion of a business transaction. When negotiations with the said partner begin, the contract has been conferred.

3. If the client, who has been given information or put in contact with the partner by the firm B. Hilleprandt with the aim of making a contract, already knows the said partner or has already entered negotiations with a mediator for the said partner, he must immediately make this known to the firm B. Hilleprandt with written proof of this by registered letter. If he does not, he cannot claim this at a later date. If he himself has earlier knowledge about the object, this has no effect on the contract. Even in this case the client is required to pay the entire provision.

4. All offers reserve the right to error or prior utilization or sale.

5. The proven objects, documents, plans, calculations, etc must be treated confidentially. The client must pay the firm B. Hilleprandt the entire provision, if a contract is made based on confidential information given to a third party. This does not affect any claims of the firm B. Hilleprandt on a third party.

6. The provision claim comes into being with the closing of a contract for purchase, rental or other agreements by the Firm B. Hilleprandt or mediated by the firm B. Hilleprandt. The provision claim also exists when the object is obtained without signing a contract, in particular when the object is obtained in a forced auction, through bankruptcy process or expropriation.

7. The full fee claim (also) comes into being even when other parties also have a responsible share in closing a contract. The objection of lacking cause and effect is expressly excluded. This holds especially for the case in which prospective buyers informed by the firm B. Hilleprandt within three years after conclusion of a contract mediated by the firm B. Hilleprandt , close further business transactions which have an economic connection to the original conferred contract or further conferred contracts. An economic connection exists when contact with the Firm B. Hileprandt leads to further contracts, which according to these conditions, have provision responsibilities to the firm B. Hilleprandt. This claim ensues even when the business transaction is not signed by the client himself but instead is concluded alone or together with others by husband or wife or a close relative or in-law or other natural or legal individual who has a close social or economic relationship to the client and has a contractually close relationship to him.

8. The provision claim is not dissolved when the said or mediated contract is canceled or because of any reasons becomes invalid. If the contract is disputed, the provision claim remains for the party who set up the reason for dispute. This party is responsible for the damages which result because the provision share of the other contract partners must be paid back.

9. Changes in the general business services are valid only after written confirmation by the Firm B. Hilleprandt. In the event that one or more changes in the general business conditions are made, they are only valid if they are verified in writing by the Firm B. Hilleprandt. The invalidity of one or more of these general business conditions has no effect on the other business conditions.

10. The court of jurisdiction and place of claims is Munich.

11. The amount of the provision is for all types of sales

3.57 % including sales tax for the buyer +

3.57% including sales tax for the inheritance (building) receiver

Sale of a business or firm

5.95 % including sales tax for the seller

Rentals

2.38 months of rent including sales tax for the tenant

Business rentals

3.57 months rent including sales tax
+ 3,57 % including sales tax of the transfer fee for the tenant
